Product Hazards

Choking Hazard

Our products contain items which are small parts and could be a choking hazard. Adequate adult supervision must be provided for children of all ages at all times while using our products in order to prevent product mouthing. Toddle Tasks accepts no responsibility or liability where adult supervision has not provided in order to prevent ingestion or choking of products.

Allergy Hazard

Our products are prepared and packed in an environment where allergens such as nuts, gluten, wheat and eggs are consumed. Before our products are provided to an infant, please consider any allergies or disorders they may have. Do not provide our products to an infant where they may have an allergic reaction to the above ingredients. Toddle Tasks accepts no responsibility or liability due to allergic reaction.

By purchasing our products you agree to abide by the requirements set in these terms and conditions and indemnify Toddle Tasks, including its officers, directors, employees, agents, licensors and suppliers, against any claim in regards to infant choking, ingestion or allergic reaction from our products.

Order Adjustments
Toddle Tasks will accept any changes to addresses, delivery dates, messages and products, if Toddle Tasks is notified of this change via email (admin@toddletasks.com.au) no more than 6 hours following the time of purchase, and if the product delivery has not already been organised.

For subscriptions, notice of five business days before auto-renewal billing date must be given to change delivery address details or name.

We reserve the right to refuse any change requests if the above conditions are not achieved.

Cancellations

Subscriptions

Month-to-month subscription products can be cancelled at any time after the first delivery. Once the monthly billing date has passed, the product from that month cannot be cancelled. This cancellation will only apply for the months following. Please cancel using the website’s online service by 5:00 PM AEST the day before your billing date if you do not wish to receive that month’s delivery. If you wish to cancel via email, please contact us at least three business days prior to your subscription’s auto-renewal date.

If a Pre-paid subscription is cancelled, then the remaining products outstanding cannot be refunded and will be forfeited.

Other Products

Once an order has been placed through our store, we cannot offer a cancellation.

Cancellation by Toddle Tasks

When you make an order, you are making an offer to purchase, and such offer is subject to our acceptance. Your receipt of an order confirmation from us does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline or cancel your order (in whole or in part) for any reason. We may require additional verifications or information before accepting any order. Your order is not accepted until we send you shipping information for the order (or the accepted portion thereof). Notwithstanding the foregoing, you agree that, if we cancel all or a part of your order, your sole and exclusive remedy is either that (a) we will issue a credit to your credit card account in the amount charged for the cancelled portion (if your credit card has already been charged for the order) or (b) we will not charge your credit card for the cancelled portion of the order.

Returns

We do not accept any product exchanges or returns due to change of mind.

Delivery

We use a range of different delivery providers depending on your location, package size, and availability.

Time Frames and Unfulfilled Deliveries

As a guide, packages are generally fulfilled within 5 business days and then delivered within a further 5-10 business days. This time frame is dependant on the delivery company used, delivery method and procurement time. For parcels which do not arrive within a reasonable time frame, we will work with the delivery company and yourself in order to try and find a solution. By purchasing from us, you understand that delivery time frame is dependant on the delivery company and can’t be guaranteed by Toddle Tasks.

For parcels which never get delivered, we will lodge a missing parcel claim through the delivery company on your behalf. By purchasing from us, you understand that any potential refund payable to you due a missing package is dependant on the findings of the delivery company. For example, if the delivery company concludes that the package was stolen from your property then no refund can be provided.

Damaged or Missing Items
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.

If any item delivered by Toddle Tasks arrives damaged or missing, you must notify us within three business days of receiving the package via email (admin@toddletasks.com.au) and provide suitable photo evidence. Once Toddle Tasks has acknowledged the item is in fact damaged or items missing, we will offer you a partial refund or discount incentive. You agree that you are not entitled to a refund or incentive which is greater than the value of the damaged or missing item. Toddle Tasks reserves the right to determine the value of the damaged or missing component/item.

Limitation of Liability
Toddle Tasks shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Toddle Tasks has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply depending on the particular circumstances.

Typographical Errors
In the event that a Toddle Tasks product is mistakenly listed at an incorrect price, Toddle Tasks reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Toddle Tasks reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Toddle Tasks shall issue a credit to your credit card account in the amount of the incorrect price.

Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Toddle Tasks without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of New South Wales, Australia, without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Toddle Tasks products) shall be in the state or federal courts located in Sydney, New South Wales, Australia. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Toddle Tasks products) must be commenced within one (1) year after the claim or cause of action arises. Toddle Tasks failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Toddle Tasks may assign its rights and duties under this Agreement to any party at any time without notice to you.

Indemnification
You agree to indemnify, defend, and hold harmless Toddle Tasks, its officers, directors, employees, agents, licensors and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Currency
All prices are in Australian Dollars (AUD) and include any applicable GST if relevant, unless specified otherwise.

Social Media
By tagging @toddletasks or using our hashtag #toddletasks on social media you grant us permission to re-post and / or re-use the image(s) for marketing purposes.
